Violations des droit de l'homme - Julio Poch - Human rights violation!

In september 2009 werd de Nederlands-Argentijnse Transavia-gezagvoerder Julio Poch tijdens zijn laatste vlucht voor zijn pensionering in Valencia gearresteerd. Hij is nu al drie jaar van zijn vrijheid beroofd en is inmiddels onderworpen aan een uiterst dubieuze en trage rechtsgang.

Wij

• familie, vrienden, relaties, bekenden en oud-collega’s van Julio Poch

• mensen die van mening zijn dat er sprake is van schending van grondrechten en fundamentele mensenrechten in de zaak van Julio Poch

• bestuur Foundation Justice for Julio Poch en donateurs

Constateren

• dat Julio Poch al drie jaar in voorarrest zit, zonder vorm van periodieke rechterlijke controle op rechtmatigheid met omgekeerde bewijslast, hetgeen strijdig is met de fundamentele mensenrechten

• dat de Staat der Nederlanden heeft meegewerkt aan de arrestatie van Julio Poch in Spanje, een land dat in tegenstelling tot Nederland wel een functionerend uitleveringsverdrag met Argentinië heeft

• dat bij de voorbereiding en uitvoering van de arrestatie van Julio Poch algemeen aanvaarde normen en waarden op een grove manier zijn geschonden; Poch werd zelfs niet in Nederland verhoord

• dat door deze gang van zaken Julio Poch aan Argentinië kon worden uitgeleverd, hetgeen de Staat der Nederlanden mede verantwoordelijk maakt voor de situatie waarin Julio Poch zich sinds zijn arrestatie bevindt

• dat er tot op heden enkel beschuldigingen zijn en geen enkel bewijs is dat Julio Poch in enige mate schuldig is aan de misdaden waarvan hij wordt verdacht

• dat het (politiek geïnspireerde) proces naar verwachting zeker drie tot vier jaar kan duren of zelfs langer bij hoger beroep

• dat Julio Poch zich in de vijf maanden die hij op borgtocht is vrij geweest, correct en conform de regels heeft gedragen

Verzoeken

• U erop toe te zien dat de grondrechten en mensenrechten van Julio Poch niet verder worden geschonden

• U het proces tegen Julio Poch nauwlettend te volgen en te toetsen aan de regels van een ‘fair trial’

• U alles in het werk te stellen om te voorkomen dat Julio Poch als Nederlands staatsburger in Argentinië als politieke zondebok wordt gebruikt

• U zich op het hoogst mogelijke niveau in te zetten om te bewerkstelligen dat Julio Poch zowel tot de aanvang als voor de duur van het proces op borgtocht wordt vrijgelaten.

• those who are of the opinion that in the present case there is clear violation of Julio Poch's basic legal and fundamental human rights

Conclude

• that Julio Poch has spent 3 years in custody now, without any form of periodical judicial check on legality and with the introduction of reversed burden of proof, which is at odds with fundamental legal and human rights

• that the State of The Netherlands has collaborated in the arrest of Julio Poch in Spain, a country which in contrast to The Netherlands, has a functioning extradition treaty with Argentina

• that in the preparation and execution of Julio Poch's prosecution generally accepted norms and values have been grossly violated, Poch was even not heard or interviewed in The Netherlands

• that through this course of action Julio Poch could be extradited to Argentina, which renders the State of The Netherlands co-responsible for the situation in which Poch finds himself ever since his arrest

• that up till now there are only recriminations and no proof whatsoever that Julio Poch should be guilty of the crimes of which he is suspected

• that this (politically inspired) prosecution easily can last for another 3 or 4 years or even longer in case of appeal

• that Julio Poch during the 5 months he was free on bail conducted himself correctly and conform the rules

Request

• you to see to it that the basic legal and human rights of Julio Poch will not be violated any further

• you to observe the case against Julio Poch closely and to check against the internationally accepted rules and conditions of fair trial

• you to contribute whatever efforts available to you to prevent the Dutch citizen Julio Poch from being used as a political scapegoat in Argentina

• you to take action at the highest possible level in order to make sure Julio Poch will be released on bail both before commencement and during the upcoming trial.

• Aquéllos que creen que en el presente caso existe una clara violación de los derechos fundamentales y legales de Julio Poch

Consideramos

• Que Julio Poch lleva tres años en prisión preventiva, sin ninguna clase de verificación judicial periódica de legalidad e introduciendo la inversión de la carga de la prueba lo cual es incompatible con los derechos humanos fundamentales y legales

• Que el Estado de los Países Bajos colaboró con la detención de Julio Poch en España, un país que a diferencia de Holanda, tiene vigente un Tratado de Extradición con Argentina

• Que en la preparación y ejecución del procesamiento de Julio Poch se violaron groseramente normas y valores generalmente aceptados ; Poch no fue interrogado en Holanda

• Que mediante estas acciones Julio Poch pudo ser extraditado a la Argentina, lo que convierte al Estado Holandés en co-responsable por la situación en la que Julio Poch se encuentra a partir de su detención

• Que a la fecha hay únicamente recriminaciones y ninguna prueba de que Julio Poch sea culpable en grado alguno de los crímenes que se le atribuyen

• Que este proceso – políticamente inspirado – puede fácilmente durar de tres a cuatro años o aún más en caso de apelar

• Que Julio Poch durante los 5 meses en que estuvo libre bajo fianza se comportó correctamente y conforme a las reglas

Solicitamos

• Que aseguren que los derechos fundamentales y derechos humanos de Julio Poch no continuarán siendo violados

• Que observen de cerca el juicio contra Julio Poch de manera que se ajuste a las reglas y condiciones universalmente aceptadas de un juicio justo

• Que realicen todos los esfuerzos posibles para evitar que el ciudadano holandés Julio Poch sea utilizado como un chivo expiatorio político en Argentina

• Que tomen acción al más alto nivel posible para asegurar que Julio Poch sea excarcelado bajo fianza tanto antes del inicio del juicio como durante la realización del mismo.

Constatons

• que Julio Poch est en détention préventive depuis trois ans déjà, sans aucune forme de contrôle judiciaire périodique de la légalité de renversement du fardeau de la preuve, ce qui est contraire aux droits de l’homme fondamentaux

• que l’Etat des Pays-Bas a collaboré à l’arrestation de Julio Poch en Espagne. Contrairement aux Pays-Bas, ce pays a conclu un traité d’extradition efficient avec l’Argentine

• que à la préparation et à l’exécution de l’arrestation de Julio Poch les normes généralement admises et les valeurs ont été violées d’une manière grossière, Aux Pays-Bas on n’a même pas interrogé Poch

• que cette procédure a permis l’extradition à l’Argentine de Julio Poch, ce qui rend l’Etat des Pays-Bas en partie responsable de la situation dans laquelle se trouve Julio Poch depuis son arrestation

• que, à ce jour, il y a des accusations seulement et aucune preuve que Julio Poch, dans une certaine mesure, est coupable des crimes dont il est soupçonné

• que le procès (d’inspiration politique) devrait prendre trois ou quatre ans et même plus dans le cas où l’on va faire appèl

• que, pendant les cinq mois de sa mise en liberté sous caution Julio Poch s’est conduit de façon correcte et conformément aux règles

Demandons

• de veiller à ce que les droits fondamentaux et les droits de l’homme de Julio Poch ne sont pas encore violés

• de suivre attentivement le procès et de tester les règles d’un procès équitable (fair trial)

• de faire tout votre possible pour éviter que Julio Poch en tant que citoyen néerlandais en Argentine est utilisé comme un bouc émissaire politique

• d’embrasser la cause au plus haut niveau possible afin de vous assurer que Julio Poch, á la fois jusqu’au début et pour la durée du procès, est libéré sous caution.
