Kansas 2nd Amendment Protection Act Resolution

A RESOLUTION urging President Donald J. Trump to grant a full pardon and clemency to Shane Cox and Jeremy Kettler, who, as a result of severe federal overreach, were unjustly convicted for manufacturing and purchasing firearms; and further urging the Kansas Attorney General to fully enforce Kansas law, file charges against all federal agents that violated that law, and insist the State of Kansas join in the defense of Cox and Kettler in federal court.

WHEREAS, Mr. Shane Cox, a resident of Kansas, was manufacturing firearms and firearm accessories in the State of Kansas, in accordance with the Kansas Second Amendment Protection Act (SAPA). Mr. Cox subsequently gave a silencer that was manufactured in Kansas to Mr. Jeremy Kettler, also a Kansas resident; and

WHEREAS, On November 14, 2016, Mr. Cox, a Kansas small business owner, was convicted on eight counts for illegally making and marketing firearms, and Mr. Kettler, an Iraq and Afghanistan war veteran, was convicted on one count for purchasing a silencer; and

WHEREAS, SAPA nullified any and all claims the federal bureaucracy had of regulating their activity under the Commerce Clause or taxing authority due to its provision of protecting the 2nd Amendment as understood when Kansas joined the union in 1861; and

WHEREAS, The Tenth Amendment of the United States Constitution guarantees all power that has not been delegated to the federal government shall be vested in the states and their citizens; and

WHEREAS, The Second Amendment of the Constitution reserves to the people, individually, the right to keep and to bear arms; and

WHEREAS, The Constitution of the State of Kansas secures to the people of Kansas the unabridged right to keep and bear arms;

Now, therefore, BE IT RESOLVED by the gun owners, citizens, legislators, State officials and Republicans of Kansas, that we urge President Donald J. Trump to grant a full pardon and clemency to Shane Cox and Jeremy Kettler, who, as a result of severe federal overreach and dereliction of duty of duly sworn Officers of the State of Kansas to enforce Kansas law, were unjustly convicted for manufacturing and purchasing firearms; and

BE IT FURTHER RESOLVED that the Attorney General of Kansas is vigorously urged to fully enforce Kansas law, file charges against all federal agents that violated that law, and have the State of Kansas join in defense of Shane Cox and Jeremy Kettler in federal court; and

BE IT FURTHER RESOLVED that the Kansas Secretary of State provide an enrolled copy of this resolution to the President of the United States of America, the United States Attorney General, the Kansas Attorney General, the Governor of the State of Kansas and the Kansas Congressional Delegation.
